Clariter S.A. (“Clariter“, “Company” “we” or “us“) respects the privacy of the users of its website at the address 
https://www.clariter.com/ (the “Site“) (“User” or “you”) and is committed to protect the personal information that its Users share with it. We believe that you have a right to know our practices regarding the information we may collect and use when you use our Site.

Clariter respects and takes into account the major data protection principles and requirements of the countries where we operate.  This includes the requirements that apply to the transfer of personal information from one country to another. 
Capitalized terms which are not defined herein, shall have the meaning ascribed to them in our Terms of Use at 
www.clariter.com/terms-of-use, which this Privacy Policy is incorporated thereto by reference.

1. Your Consent (Please read carefully!)

BY ACCESSING THE SITE AND/OR USING THE SITE, YOU AGREE TO THE TERMS AND CONDITIONS SET FORTH IN THIS PRIVACY POLICY (THE “PRIVACY POLICY“), INCLUDING TO THE COLLECTION AND PROCESSING OF YOUR PERSONAL INFORMATION (AS DEFINED BELOW) IN THE EVENT YOU DECIDE TO PROVIDE US WITH SUCH IN OUR SITE’S FORM. IF YOU DISAGREE TO ANY TERM PROVIDED HEREIN, YOU MAY NOT USE THE SITE.

2. Which information we may collect on our Users?

We may collect two types of data and information from our Users:

a. The first type of information is non-identifiable and anonymous information (“Non-personal Information”). We are not aware of the identity of the User from which we have collected the Non-personal Information. Non-Personal Information is any unconcealed information which is available to us while Users are using the Site. Non-personal Information which is being gathered consists of technical information and behavioral information, and may contain, among other things, type of operation system (e.g. Windows, Linux, etc.), computer configurations, screen resolution (e.g. 800×600, 1024×768, etc.), type of browser, keyboard language (e.g. English), the activity of the User on the Site and User’s ‘click-stream’ on the Site, etc.

b. The second type of information is individually identifiable information (“Personal Information”). This information may identify an individual or may be of a private and/or sensitive nature.

  • Users of the Site automatically provide the User’s IP address and unique device identifiers mainly for enhancing
    the User’s experience and for geolocation and security purposes as further detailed below.
  • In addition, Personal Information which is being gathered consists of any personal details provided
    consciously and voluntarily by the User. The Personal Information is collected from the details the Users provide
    when Users wish to contact us or download a file via the Site which requires, among others: name, e-mail address, i
    ndustry, phone number and other additional gathered information and comments.

For avoidance of doubt, any Non-Personal Information connected or linked to any Personal Information shall be deemed as Personal Information as long as such connection or linkage exists.

We do not collect any Personal Information from you or related to you without your approval, which is obtained, inter alia, through your active acceptance to the Terms and the Privacy Policy.

3. How Do We Collect Information on Our Users?

There are two main methods we use:

a. We collect information through your use of the Site. In other words, when you are using the Site we are aware of it and may gather, collect and record the information relating to such usage, either independently or through the help of third-party services, as detailed below.

b. We collect information which you provide us voluntarily. For example, we collect Personal Information which you voluntarily provide when you fill in the contact form. We store the Personal Information either independently or through the help of our authorized third-party service providers as detailed below. Please keep in mind that once you voluntarily provide us with your Personal Information we may collect information comprised of both collection types together.

4. What are the Purposes of the Collection of Information?

Non-personal Information is collected in order to:

  • Use it for statistical and research purposes and for development, customization and improvement of our Site’s interface;
  • Provide our User with a better user experience

Personal Information is collected in order to:

  • Be able to send Users newsletters;
  • Be able to contact Users for the purpose of providing them with further information on Clariter and its products and services;
  • Be able to send our Users brochures and other marketing materials if requested;
  • Be able to provide the Users updates about the Company’s developments.

5. How do we use information collected?

We use information that we collect for lawful purposes associated with the growth, maintenance and management of our website, while also respecting your privacy.  These uses include communicating with you, for advertising and marketing, to monitor & maintain functionality and to improve, develop, enhance and provide the Clariter website, products and services.
Clariter may transfer your personal information to other Clariter owned business entities/subsidiaries. By accessing Clariter websites, or otherwise providing Clariter with your personal information, you consent to this transfer of your personal information throughout the global Clariter network of entities.

6. Sharing Information with Third Parties

Clariter will not share any Personal Information it collects with any third party. Notwithstanding, Clariter may disclose Personal Information in the following cases: (a) to satisfy any applicable law, regulation, legal process, subpoena or governmental request; (b) to enforce this Privacy Policy and/or the Terms of Use, including investigation of potential violations thereof; (c) to detect, prevent, or otherwise address fraud, security or technical issues; (d) to respond to User’s support requests; (e) respond to claims that any content available on the Site violates the rights of third-parties; (f) to respond to claims that contact information (e.g. name, e-mail address, etc.) of a third-party has been posted or transmitted without their consent or as a form of harassment; (g) to protect the rights, property, or personal safety of Clariter, its Users, or the general public; (h) when Clariter is undergoing any change in control, including by means of merger, acquisition or purchase or sale of all or substantially all of its assets; or (i) to collect, hold and/or manage your Personal Information through Clariter’s authorized third party service providers (for example, Google Analytics), as reasonable for business purposes, which may be located in a country that does not have the same data protection laws as your jurisdiction; (j) pursuant to your explicit approval prior to the disclosure; or (k) cooperate with third parties for the purpose of enhancing the User’s experience.

For avoidance of doubt, Clariter may transfer and disclose to third parties, or otherwise use, Non-personal Information at its own discretion.

If you request a change to or deleting of your personal information, please note that we may still need to retain certain information for record keeping purposes, and/or complete any transactions that you began prior to requesting such change or deletion. Some
of your information may also remain within our systems and other records where necessary for compliance with applicable law.

7. Transfer of Information Out of Your Country

Consistent with this Privacy Policy as in accordance with applicable legal requirements, we may collect, transfer, store, and process your information outside your country of residence. Please note that the data protection and other laws of countries to which your information may be transferred might not be as comprehensive as those in your country.  Nevertheless, Clariter has taken steps to ensure an adequate level of protection of your data irrespective of the country where it is transferred.

8. Deletion of Personal Information

If for any reason you wish to modify or delete your Personal Information please send us an email to: [email protected], and we will make reasonable efforts to modify or delete any such Personal Information pursuant to any applicable privacy laws. Note that unless you instruct us otherwise we may retain your Personal Information for a period of ninety (90) days or a longer period as reasonably required and/or as legally required.

9. Minors

Clariter does not knowingly collect information from children as defined by local law, and does not target its websites to children.
To use the Site, you must be over the age of thirteen (13). Clariter does not knowingly collect Personal Information from children under the age of thirteen (13) and does not wish to do so. We reserve the right to request proof of age at any stage so that we can verify that minors under the age of thirteen (13) are not using the Site. If we learn that we have collected the personal data of a child under the age of 13 years, we will take reasonable steps to delete the personal data.

10. Security

We take a great care in implementing and maintaining the security of Clariter’s Site and its User’s Personal Information. Clariter employs industry standard procedures and policies to ensure the safety of its Users’ Personal Information, and prevent unauthorized use of any such information, including by using firewalls.  The Personal Information may be hosted at Clariter’s premises or at its third party services providers, under advanced security features and protection. However, we do not guarantee that unauthorized access will never occur.

11. Third Party Software/Service

While providing the Site, we may be using third party software and/or services in order to collect and/or process the
information detailed herein. Such services include, without limitation, Google Analytics, which privacy policy is available at 
http://www.google.com/intl/en/analytics/privacyoverview.html. Please be advised that such Third Party Services are independent from Clariter, and if you click on any of the links to the Third Party Services, these Third Party Services may use cookies and other web-tracking technologies to collect Non-Personal and/or Personal Information about you. We assume no responsibility or liability whatsoever with regard to privacy matters or any other legal matter with respect to such services. We encourage you to carefully read the privacy policies and the terms of use or service of such third parties, as their terms, not ours, will apply to any of your interactions with such third parties.

12. Cookies

When you access or use the Site, the Company or any of its Third Party Services providers (e.g. Google analytics) may use industry-wide technologies such as “cookies” (or similar technologies), which store certain information on your computer (“Local Storage“) and which will allow us or our Third Party Services to enable automatic activation of certain features, and make your service experience much more convenient and effortless. It is easy to prohibit the Local Storage. Most browsers will allow you to erase cookies from your computer’s hard drive, block acceptance of cookies, or receive a warning before a cookie is stored. However, if you block or erase cookies your online experience may be limited.

Direct Marketing: You hereby agree that we may use your contact details for the purpose of informing you regarding our products and services which may interest you and commercial updates about Clariter’s events and news appearances, and to send to you other marketing material, transmitted to the e-mail address you have provided. You may withdraw your consent via sending a written notice to Clariter by email to the following address: [email protected].

14. Changes to the Privacy Policy

The terms of this Privacy Policy will govern the use of the Site and any information collected therein. Clariter reserves the right to change this policy at any time, so please re-visit this page frequently. We will provide notice of substantial changes of this policy on the homepage of the Site and/or we will send you an e-mail regarding such changes to the e-mail address that you may have provided us with. Otherwise, all other changes to this Privacy Policy are effective as of the stated “Last Revised” date and your continued use of the Site after the Last Revised date will constitute acceptance of, and agreement to be bound by, those changes.
